About these Terms
This website is owned and operated by Running on Sunshine Pty Ltd (ABN 37 635 758 440), which trades as Chasing Sunshine Sydney™ (Chasing Sunshine Sydney, we, us or our). Among other things, we sell our products and services through this website.
These terms apply to the ordering, purchase and delivery of products and services through this website and all other means. You will be bound by these terms and by our Returns Policy each time you place an order for any of our products and services.
We may vary these terms. Please refer to this page from time to time to refresh your understanding of these terms and review any new information.
Placing an Order
You may place an order with us if you are at least 16 years of age (or at least 13 years of age if you have permission from a parent or guardian).
When you place an order with us, you are making an offer to enter into a contract for us to sell to you, and you to purchase from us, the products and services in your order that we can supply. Each order you place with us will be a separate contract.
You warrant that your orders are intended for personal, non-commercial use only and will not be re-sold as new products.
From time to time, we may restrict the quantity of products that can be purchased in one order or during a particular period of time or per person or per address. Any quantity restrictions will be stated on the product page, or in materials about the relevant promotion, or as otherwise advised to you.
We may also impose maximum order values from time to time as a credit protection measure. Any maximum order value will be inclusive of GST and delivery charges.
We reserve the right to accept or reject an order for any reason at any time, whether in whole or in part. Without limiting the above, we may reject an order to the extent it is based on incorrect information represented on this website due to human or system error.
If we do not accept an order, or accept only part of an order, you will receive a refund of any money paid in respect of any products and services that we do not agree to sell to you.
Orders for Delivery within Australia
We ship Australia-wide via Australia Post or Couriers Please.
We offer free shipping for orders over $200.00. Otherwise, we will apply a flat rate shipping cost at checkout. Sometimes we will have free shipping promotions.
We aim to dispatch all our orders within two working days for delivery within one to five working days of dispatch. However, as delivery is subject to third parties, we cannot guarantee delivery within any specific timeframe.
Orders for International Delivery
We currently* ship from Australia to the following jurisdictions via DHL, UPS or Australia Post:

- France (excluding overseas territories)

- Indonesia
- Italy

- New Zealand (excluding dependent territories)

If you do not live in one of these jurisdictions, please contact us to discuss shipping arrangements and costs.
Our international shipping costs vary depending on destination and quantity and will be calculated at checkout.
We aim to dispatch all our orders within two working days. Please allow between five to 15 working days for delivery from the shipment date. However, as delivery is subject to third parties and customs clearance, we cannot guarantee delivery within any specific timeframe.
You may be required to pay additional amounts in the delivery jurisdiction for your order, including import duty, GST or VAT, customs clearance charges, and brokerage or handling fees and charges. These additional amounts are your responsibility and you will generally need to pay them before your order can be delivered. Please contact your local customs office for more information regarding these additional amounts.
Price and Payment
When you place an order, we will charge you and you agree to pay the price we quote together any applicable shipping cost.
All prices we quote on this website are in Australian dollars and, if GST applies, inclusive of GST. Any fees and charges (including shipping costs) imposed by these terms also include GST, if it applies.
We may change our quoted prices without notice to you. If you have already placed an order at a particular price, and we accept your order, we will fulfil your order at that price (unless your order is affected by a pricing error).
Accepted payment methods are specified at the time you place an order. The name on any credit card used for payment must match the name on the order. Other methods of payment, including cash, cannot be used to pay for orders. Payment methods may be subject to change.
Any payment for an order must be cleared by us before we will dispatch products. If your payment cannot be processed, your order will be rejected and you will be notified of this. If a credit card payment cannot be processed you should contact your card issuer to try to resolve the problem, or use an alternative credit card or other accepted payment method in order to continue with your order.
In paying or attempting to pay for an order, you agree that you have not engaged in any fraudulent conduct or contravened any applicable law.
Confirmation of Order
We will confirm receipt of your order promptly via the email you supplied to us with the order. This confirmation email constitutes our acceptance of your offer whether or not you receive it. It is your responsibility to ensure that the correct email address and contact details are entered with your order, and that your email program accepts emails from us.
On dispatching your order, we will send you a shipping confirmation email that includes a tracking number that you can use to track the shipment status of the order using the link provided.
We are not able to combine shipping for two separate orders – each order will be dispatched separately.
We may split your order into multiple shipments at our discretion.
Currently, significant delays are being experienced in domestic and international shipping due to the COVID‑19 pandemic. This may affect any delivery estimate we give you.
Delivery
We are not able to change a delivery address or redirect an order after dispatch. However, please email us at hello@chasingsunshinesydney.com immediately if you have made an error in delivery address details, and we will try our best to help.
It is your responsibility to ensure that there is appropriate and safe access to your delivery address.
Risk and title in products that you order passes to you at the time they are delivered to your delivery address. Except to the extent required by law, we will not refund or replace items that you do not receive but which are tracked as having been delivered to your delivery address.
Product Warranties
Our products come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
We exclude to the fullest extent possible under law, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these terms.
Product Information
We endeavour to depict products available for order using accurate images of the products. At times, however, products actually delivered may to a small extent differ in appearance and packaging from their appearance in images and photographs on this website. For example, product dimensions may very slightly.
We recommend that you read the labels and instructions on products prior to use.
Online Gift Cards
Online gift cards are not issued in physical form but as a store credit. They are only redeemable for purchases on this website. No change will be given for a purchase made with an online gift card, but the remaining credit may be redeemed against another purchase. An online gift card expires on the second anniversary of the date it was purchased. They are partially redeemable, and it is up to the cardholder to use the full value within the validity period. Any unused balance will not be refunded or credited when the card expires. When the cost of a purchase exceeds the available card balance, the cardholder will be required to make up the difference with an alternate form of payment. Gift cards should be treated like cash and the reference number kept secret. We disclaim all responsibility for lost or stolen online gift cards.
If you receive a refund on a product purchased using an online gift card, we will either credit the amount redeemed back to the online gift card or issue a new online gift card to you for that amount.
Termination
We may, at our discretion, terminate any contract for the supply of products and services to you:
- for convenience, at any time, on giving notice to you; or
- immediately if we reasonably believe that you have breached these terms.
Governing Law and Jurisdiction
These terms and any contract formed on our acceptance of an order are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of, and Commonwealth courts having jurisdiction in, New South Wales, Australia and waive any right to object to proceedings being brought in those courts on the basis that proceedings have been brought in an inconvenient forum.
